ADSL - Terms and Condtitions

  1. Installation of service is normally within 15 days from application date, however it could vary between 1~6 weeks depending on the demand. NextWeb cannot be held responsible for applications that take longer than normal to be completed.


  2. Payment Terms - are strictly cash in advance unless credit terms are agreed. On-Site installation will not be completed unless full payment is received upon completion.


  3. The telephone point where the ADSL Modem is to be installed, is to be within one meter from the computer, and properly terminated with a standard BT socket. Any additional wiring required is at the client’s responsibility. Also for the requirement of filtering the ADSL service from the standard voice calls, the client must reliably inform NextWeb technician of how many telephone points are installed, even unused once, in the place of installation.


  4. The one time setup charge includes ADSL line setup connection charges and On-Site installation by NextWeb technical staff. On-Site installation is limited up-to a maximum of ONE hour, subsequent hours or part of will be charged extra a-t the rate of Lm8 per hour.


  5. New subscriptions start from the date of installation and Un-Locking of the ADSL Port with NextWeb, and not from the application date.


  6. Should the user decided to termination the ADSL subscription, the ADSL modem and respective Filter in good working condition is to be returned to NextWeb Ltd., 219-221, Parilja Street, Santa Venera, whom will refund any modem deposit paid.


  7. One Distributed ADSL Filter is provided FREE of charge with the ADSL modem. Extra Distributed filters have to be bought extra at their respective prices. Installation with more than 4 telephone points are highly recommended to use the Centralized filter solution.


  8. NextWeb shall endeavour to provide you with the requested downstream connection speed. The connection speed is the speed at which data is transferred between your computer and the ISP routers. The maximum connection speed that can be achieved on your ADSL line will vary based on a variety of factors, including, but not limited to:

    • the distance of your premises to the provisioning exchange
    • condition of wiring up to your premises
    • condition of wiring within your premises
    • number and type of appliances connected to your line

    Should tests prove that provision of the requested connection speed is not possible, your line speed will be synched at the maximum speed achievable on your line. No reduction in standard charges or discounts shall be possible in such cases.


  9. When the maximum download limit in the current month period is exceeded and no extra topping download GBs are available on account, the connection will be restricted to the local backbone ONLY (services hosted in Malta), no international access will be available. The e-mail service (username@nextweb.net.mt) will NOT be restricted in any way whatsoever. The full service will automatically be restored with the start of the next month period or upon purchasing Extra Download Capacity top-ups.


  10. Any unutilized balance from the monthly download limit will be lost at the end of the period, however any balance from Top-Ups purchased will be carried over to the next period.


  11. NextWeb will not offer refund for the early termination of service by subscribers, or refunds for paid-up periods and/or extra topping GBs which have not been utilised by the subscriber.


  12. Deposits on ADSL subscriptions (excluding deposits on ADSL modems) are not refundable.


  13. Should the client want to cancel an ADSL application which is still pending Activation / Installation, a Lm5 charge is applicable which will be deducted from the refund of the application. This charge does not apply in case where service cannot be provided due to technical reasons.


  14. NextWeb will do its best in keeping the subscribers up-to-date with their account status, for this purpose detailed information re the account is provided via the members section on the Website. Also for the benefit of the subscriber auto generated E-mail reminders are sent on the E-mail provided with the service, therefore regular e-mail reading is recommended. If no renewal is affected within 3 days from the expiry date, NextWeb will disconnect the ADSL service. Subsequently, for the service to be reactivated, the respective FULL One-Time Installation charge will be applicable.


  15. Renewal’s start date is always the next day after the expiry date of the previous subscription. No days can be skipped even if the service was not used by the subscriber.


  16. Subscriptions or Renewals of less then 3 months are subject to an administrative fee of Lm1.00 / €2.33


  17. NextWeb’s Helpdesk will do its best to assist subscribers experiencing problems with their ADSL line, by liaising with Maltacom, to get their service restored as soon as possible. However, NextWeb cannot be held responsible for any delays in the service restoration and/or poor service quality as a result of any failure in the ADSL line which is beyond its control.


  18. The FREE phone support form the NextWeb’s helpdesk is strictly limited for problems directly related to NextWeb ADSL installation which can be tackled in a reasonable time over the phone. Other problems can be handled by NextWeb’s technical support at their respective charges.


  19. All prices quoted are inclusive of VAT.


  20. The ADSL service is made up of the Internet Access Service which is provided by NextWeb Ltd and the ADSL circuit which is provided by Maltacom.


  21. The ADSL service is available for Maltacom residential and business telephone lines, using a USB or Ethernet ADSL modem. A service will be deemed to qualify for residential or business rates as per the listing of Maltacom plc for the telephone number on which the service is being requested.


  22. Changes to these NextWeb ADSL Service Terms and Conditions can be effect at a 30 Days notice. Last updated on 25th May 2007.
